Conservation easement tax benefits: what South Carolina landowners need to know

If you own land in the Pee Dee region, you have probably thought about what happens to it after you are gone. Selling it outright often means development. Passing it to heirs without a plan can leave them with a hard choice they were not ready to make. A conservation easement is a third option, and it carries real tax benefits worth knowing about.

How a conservation easement works

A conservation easement is a voluntary legal agreement between a landowner and a nonprofit like Pee Dee Land Trust. You keep ownership of the property. You can farm it, live on it, and pass it to your children. The easement permanently restricts certain future uses, like subdivision or commercial development.

Agreeing to those restrictions may qualify you for substantial tax benefits at the federal and state level.

Federal income tax deduction

The IRS treats a donated conservation easement as a charitable contribution. The deductible amount equals the difference between what your land is worth with full development rights and what it is worth after the easement is placed. A qualified appraiser determines that figure, and it becomes your contribution value.

Most landowners can deduct up to 50 percent of adjusted gross income in the year of the donation. Qualified farmers and ranchers can deduct up to 100 percent. Any unused deduction carries forward for up to 15 years.

For agricultural or wooded property with meaningful development value, this deduction can offset a real portion of your federal income tax over that 15-year window. The dollar amount depends on what your land would have been worth to a developer, which is why the qualified appraisal is the foundation of the whole process.

Estate tax relief for your family

When land carries a conservation easement, it is appraised at a lower value for estate tax purposes because development rights are restricted. That lower valuation reduces what your heirs owe.

Estate tax bills force sales. An easement placed now can mean your children keep the property rather than liquidate it to cover the bill. We hear this concern often from families with land that has been in their name for two or three generations. The land itself may not generate much income, but the estate value is significant. An easement addresses that gap.

South Carolina state tax benefits

South Carolina offers a state income tax credit for qualifying conservation easement donations made to organizations like Pee Dee Land Trust. This credit stacks on top of the federal income tax deduction, so a landowner working with a solid CPA can benefit at both levels in the same tax year.

The specific credit percentage and income limitations change periodically, so confirm the current rules with a qualified tax advisor before you finalize your donation. South Carolina has historically been a favorable state for conservation easement donors, and that track record is worth discussing with your attorney.

Possible property tax savings

In some South Carolina counties, land in agricultural use programs or carrying conservation designations may qualify for a reduced property tax assessment. Rules vary by county. Ask your assessor and your land trust contact how this applies to your parcel.

Why most landowners do it anyway

Most of the landowners we work with already know they want to protect their land before they hear a word about tax benefits. They watched a family farm across the road sell and get subdivided. They walked the property with their kids and wondered what it would look like in thirty years.

The financial benefits make it easier to act. For some families, they make it possible. But they are rarely the reason someone picks up the phone.
