Agricultural Land Preservation in South Carolina

Across the Pee Dee watershed, family farms have fed generations and shaped the landscape of South Carolina. Agricultural land preservation in South Carolina gives farming families a permanent way to protect that land from development, while keeping every right to farm it, hunt it, and pass it down.

For many landowners, the farm is not just an asset. It is a place tied to memory, to family, and to the rhythms of planting and harvest that outsiders rarely understand. Protecting it permanently means that story does not end with the next generation, or the one after that.

Why Agricultural Land Preservation in South Carolina Matters

Farmland across the Pee Dee region faces constant pressure from growth and development. Once a working farm is subdivided or sold for commercial use, it rarely returns to agriculture.

Agricultural land preservation in South Carolina gives landowners a legal tool to stop that cycle before it starts. A conservation easement keeps the land in farming hands, permanently, no matter who owns it next.

For families who have worked the same fields for generations, this is not just about soil and crops. It is about keeping a way of life intact for the people who come after.

It also matters beyond the property line. Working farmland absorbs rainfall, slows runoff, and filters water before it reaches a creek, a river, or a neighbor’s well. Every acre kept in farming instead of pavement helps the whole Pee Dee watershed.

How a Conservation Easement Protects a Working Farm

A conservation easement is a voluntary legal agreement between a landowner and Pee Dee Land Trust. The landowner keeps full ownership of the property.

Nothing about daily life on the farm changes. The owner can keep farming, hunting, and living on the land, and can pass it to heirs just as before.

The only thing given up is the right to develop the property. No subdivisions. No commercial construction. The easement is recorded with the county, so the protection follows the land through every future owner.

That last part is what makes the tool so different from a handshake promise or a family understanding. A will can be challenged. A verbal agreement between neighbors can be forgotten. A recorded conservation easement cannot.

Getting started is simple, and it does not commit a landowner to anything right away.

  1. A conversation with Pee Dee Land Trust staff, with no cost and no commitment.
  2. A visit to the property to understand its conservation value.
  3. An independent appraisal to establish the land’s conservation value.
  4. A custom easement drafted by Pee Dee Land Trust attorneys and reviewed by the landowner before anything is signed.
  5. Recording the easement with the county, making the protection permanent.

The process usually takes twelve to eighteen months, and there is no upfront cost to the landowner. Tax outcomes vary by situation, so Pee Dee Land Trust always recommends talking with your own attorney or CPA along the way.

What You Keep and What You Give Up

Landowners considering agricultural land preservation in South Carolina often ask what they are actually giving up. The answer is short.

You keep ownership. You keep the ability to farm the land, hunt it, and leave it to your children or grandchildren. You keep the freedom to live your life on the property exactly as you do now.

You give up one thing only: the right to develop the land. The farms that have fed Pee Dee families for generations can keep doing exactly that, forever.

This distinction matters because many landowners assume a conservation easement means giving up control. It does not. Pee Dee Land Trust is not a partner in running the farm, and it does not dictate crops, livestock, or how the land is worked day to day. Its role is limited to making sure the land is never developed.

Who Can Protect Agricultural Land This Way

Any private landowner in the Pee Dee region with significant agricultural, natural, or historic land may be eligible for a conservation easement. Eligibility is based on the conservation value of the property, not on acreage alone.

That includes active row crop and livestock operations, timberland managed alongside farming, and family land that has been worked for decades but is now facing pressure from nearby development. A free initial conversation with Pee Dee Land Trust staff is the way to find out where a specific property stands.

Some landowners come to Pee Dee Land Trust already set on protecting a farm forever. Others are simply curious about their options and want to understand the tradeoffs before deciding anything. Both are welcome to start the same way, with a phone call and no pressure to commit.

Timing matters too. Landowners thinking through a will, a family succession plan, or how a farm will transfer to the next generation often find that a conservation easement fits naturally into that planning, since the land’s future use is settled well before any transfer happens.

Permanent Protection Across the Pee Dee Watershed

Pee Dee Land Trust has worked for more than 20 years to protect significant natural, agricultural, and historic land across a nine county service area in South Carolina.

That work includes protected places like Witherspoon Island, where 3,708 acres are preserved for good. Farmland easements work the same way. Once recorded, the protection is permanent. It cannot be undone by a future owner, a developer, or a shift in the market.

That permanence is the whole point. A conservation easement does not pause development pressure for a few years. It removes it for good, for that farm and for every owner who comes after.
